Terms and conditions of sale

Last updated November 5, 2026.

These terms apply to every quote, order, sample pack, prototype and production part supplied by InLoop Foam, Inc. (“InLoop Foam,” “we” or “us”) to a customer (“you”). By placing an order, paying an invoice or accepting delivery, you agree to these terms. They take precedence over any different or additional terms in your purchase order or other documents unless we agree otherwise in a signed writing. Use of this website is also governed by our terms of service.

1. Products covered

These terms cover all parts and materials we make or supply, including parts made by viscous thread printing (“VTP”), parts made by fused filament fabrication (“FFF”), sintered metal, ceramic and glass foams, polymer foams, sample packs and prototypes (together, “Products”).

2. Instant quotes are estimates only

Prices, lead times, masses and other figures produced by the automatic quote tool on this website are budgetary estimates generated by software from the file you upload. They are provided for planning purposes only. They are not an offer to sell, and InLoop Foam, Inc. is not bound to honor them. An estimate may change after engineering review of geometry, material, density, tolerances, quantity, finishing, inspection and shipping requirements.

A binding price exists only in a written quote issued by InLoop Foam after review. Unless it states otherwise, a written quote is valid for 30 days and becomes a contract only when we accept your order in writing or begin work on it. We may correct clerical and pricing errors in any quote, invoice or order confirmation.

3. Variation in material properties

VTP forms foam by the controlled buckling and coiling of a viscous thread. This coiling is a stochastic (partly random) physical process: pore placement, strut thickness and local density vary from part to part and within a single part, even when the same toolpath and settings are used. Sintering, debinding and FFF printing add further variation in shrinkage, porosity, surface finish and mechanical, thermal, fluid and electrical properties.

Property values, densities, pore sizes, PPI figures, envelopes and other data on this website, in datasheets, in quotes or in correspondence are typical or representative values. They are not specifications and are not guaranteed for any individual Product or lot. Products may differ in appearance and properties from samples, photographs and previous orders. Only properties expressly listed as acceptance criteria in a written quote signed by InLoop Foam are binding, and then only within the stated tolerances.

4. No warranty

All Products, including all VTP and FFF parts, are provided “as is” and “with all faults,” without warranty of any kind. To the fullest extent permitted by law, InLoop Foam disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. No statement by our employees, on this website or in our literature creates a warranty.

If a Product arrives damaged, or does not match the part number, quantity or written acceptance criteria in your order, tell us in writing within 14 days of delivery. Our only obligation, and your exclusive remedy, is that we will repair or replace the Product or refund the price paid for it, at our option.

5. Your responsibility for suitability

You are solely responsible for your designs, files and specifications, and for deciding whether a Product is suitable for your application. This includes testing, qualification and certification of Products in their final use. Products are prototypes and engineering materials unless a written quote states otherwise. They are not designed, tested or certified for use in medical implants, life-support systems, aircraft or spacecraft flight hardware, pressure vessels or other uses where failure could cause injury, death or major property damage, and you use them in such applications at your own risk.

6. Limitation of liability

To the fullest extent permitted by law, InLoop Foam will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or production, however caused and even if we were told such damages were possible. Our total liability arising out of or relating to any order or Product will not exceed the amount you paid for the Products that gave rise to the claim.

7. Payment, shipping and cancellation

Unless a written quote states otherwise, payment is due before shipment. Products ship from Medford, MA, and risk of loss passes to you when Products are handed to the carrier. Delivery dates are estimates, and we are not liable for delays. Custom Products are made to order, so orders cannot be cancelled or returned once work has started, except under section 4.

8. Designs and intellectual property

You keep all rights to the files and designs you send us, and you confirm that you have the right to have them made. We keep all rights to our processes, toolpaths, process parameters and know-how, including our patents and pending patent applications on viscous thread printing. Buying a Product does not grant any license to those rights. You agree not to reverse engineer our process from Products or samples.

9. Export control

You are responsible for complying with U.S. export control and sanctions laws for Products and technical data you receive from us, and for telling us before we quote if a part or drawing is controlled under ITAR or the EAR.

10. General

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute will be heard in the state or federal courts located in Middlesex County, Massachusetts. If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms at any time; the version posted when you place an order applies to that order.
